Terms of Service
1. The Service
SpeechIntel provides tools to assign voice-based mock interviews, transcribe student responses, and generate structured AI feedback against configurable rubrics. Features, usage limits, support hours, and service levels are defined in your subscription or order form.
2. Eligibility and Accounts
- You must be a legally registered business or authorized representative.
- Account credentials are for your organization only; do not share passwords broadly.
- You are responsible for all activity under your tenant account.
3. Subscription and Payment
- Subscription fee, per-minute usage rates, and billing cycle are set in your agreement.
- Fees are invoiced in INR.
- Failure to pay may result in suspension; read-only access to export data may remain for a limited period.
- You may cancel as described in your agreement; data export windows apply after cancellation.
4. Consultancy Responsibilities
You agree to:
- Obtain valid consent from students before sending interview links
- Provide accurate student contact information
- Use the service only for lawful education and assessment purposes
- Maintain confidentiality of magic links and evaluation results
- Configure rubrics and review AI output before relying on it for high-stakes decisions
- Comply with applicable law, including the DPDP Act and rules thereunder
5. Student Experience
Students access interviews via magic links without creating SpeechIntel accounts. Students see a consent notice before recording. Your organization controls whether results are visible to students immediately or only after staff review.
6. Acceptable Use
You may not:
- Attempt to bypass tenant isolation or access another customer's data
- Scrape, reverse engineer, or overload the platform without permission
- Upload unlawful, harassing, or infringing content
- Resell or white-label access without a written agreement
- Use the service to build a competing product using non-public interfaces
7. AI-Generated Output
Evaluations and transcripts are generated automatically and may contain errors. They are advisory tools for coaches and counsellors, not guarantees of admission, visa, or test outcomes. Your staff remains responsible for final judgments shared with students.
8. Intellectual Property
- SpeechIntel retains all rights in the platform, software, and brand.
- You retain rights in your question content and rubrics you upload.
- You grant us a limited license to host and process your content solely to provide the service.
9. Confidentiality
Each party will protect the other's non-public business information shared under these Terms with reasonable care, except where disclosure is required by law.
10. Data Processing
Our processing of personal data is described in the Privacy Policy. Where you are a data fiduciary for student data, you instruct us as a processor. A separate Data Processing Agreement may apply if specified in your contract.
11. Warranties and Disclaimer
The service is provided on an "as is" basis to the extent permitted by law. We do not warrant uninterrupted or error-free operation, or that AI output will meet any particular academic or regulatory standard.
12. Limitation of Liability
To the maximum extent permitted by law, SpeechIntel is not liable for indirect, incidental, special, or consequential damages, or for admission, employment, or examination outcomes. Our aggregate liability for any claim arising from these Terms or the service is limited to fees paid by you in the twelve months before the event giving rise to the claim, except where liability cannot be limited under Indian law.
13. Indemnity
You will indemnify SpeechIntel against claims arising from your breach of these Terms, misuse of the service, or failure to obtain required consents from students, except to the extent caused by our gross negligence or willful misconduct.
14. Suspension and Termination
We may suspend access for non-payment, security risk, or material breach. Either party may terminate per the subscription agreement. Upon termination, we will retain data as stated in the Privacy Policy to allow export, then delete per retention schedules.
15. Governing Law and Disputes
These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction, subject to mandatory consumer or data protection remedies available under applicable law.
16. Changes
We may update these Terms by posting a revised version on this page. Material changes will be communicated to active customers where practicable. Continued use after the effective date constitutes acceptance.
